What is Statutory Sick Pay?
This scheme was implemented on 1 January 2023 with the introduction of The Sick Leave Act, of 2022. This law was introduced to protect the legal right of employees to be paid by their employers when they are out sick. The law was signed in July 2022 and is to be rolled out over a four-year period. In 2023, employees are entitled to be paid for up to 3 days of sick leave, 5 days of sick leave in 2024, 7 days of sick leave in 2025, and 10 days of sick leave in 2026.
Eligibility Criteria
- Employee's must have 13 weeks of continuous service with the employer.
- A Medical certificate is necessary for each day of sick leave being consumed.
- If the number of eligible sick days expires and the employee is eligible and in need of further days, they are eligible for the same from DSP but will be subjected to PRSI contributions.
Calculation of Statutory Sick Pay
The calculation of Statutory Sick Pay is set at 70% of the daily wage per employee. However, there is a cap set at €110. Therefore, an employee will either get €110 or the amount that is being calculated if it is under €110.
